1. About Simone
The Website www.simoneshop.com is operated under the commercial name Simone.
Simone is a curated online store dedicated to emerging, value-driven fashion and lifestyle brands. Brands and products are independently selected according to Simone’s editorial standards, including design, materials, transparency and production practices.
Orders placed through the Website are concluded directly between the customer and Simone. Simone is therefore the seller of the Products towards the customer, even where the preparation and shipment of the order are carried out by a partner brand on Simone’s behalf.
These Terms and Conditions govern all purchases made through the Website by consumers located within the European Union.

3. Acceptance of these Terms
Before placing an order, the customer must read and accept these Terms and Conditions.
By confirming an order, the customer acknowledges that they have reviewed the essential characteristics of the Products, their prices, applicable delivery charges and the present Terms and Conditions.
The Terms applicable to an order are those available on the Website on the date the order is placed.
4. Products and curation
The essential characteristics of each Product are displayed on its product page, including, where available:
- its description;
- its composition;
- available sizes and colours;
- its price;
- information about its manufacturing location;
The customer is responsible for reviewing this information before placing an order.
Photographs are intended to represent the Products as accurately as possible. However, minor differences in colour, texture or appearance may occur depending on screen settings, lighting or the handmade nature of certain Products.
Simone may modify product descriptions, product presentation, imagery and product positioning in order to ensure consistency across the Website.
Simone may also remove any Product or brand from the Website at any time. This does not affect orders that Simone has already accepted, unless the Product has become unavailable or the order cannot lawfully or practically be fulfilled.
5. Availability
Products are offered subject to availability.
As stock is held and managed by partner brands, a Product may exceptionally become unavailable after an order has been placed.
Where a Product is unavailable, Simone will inform the customer as soon as possible and refund all sums paid for that Product using the original payment method.
No replacement Product will be sent without the customer’s prior agreement.
6. Orders
Customers may place an order without creating an account.
Before confirming an order, customers can review and correct its contents.
An order becomes final once:
- the customer confirms the order with an obligation to pay;
- payment is authorised;
- and Simone sends an order confirmation by email.
Simone reserves the right to refuse or cancel an order for legitimate reasons, including:
- suspected fraud or unauthorised payment;
- an obvious pricing or description error;
- Product unavailability;
- an incomplete or inaccurate delivery address;
- previous unresolved payment incidents;
- an order placed for apparent resale or commercial purposes.
Where Simone cancels an order after payment, the customer will receive a full refund.
7. Prices
Prices are displayed in euros and include all taxes applicable to the customer at the time of purchase.
As Simone operates under the French VAT exemption scheme, no VAT is separately charged by Simone pursuant to Article 293 B of the French General Tax Code.
Delivery charges are displayed before the customer confirms the order.
Where an order includes Products from several brands, Products may be shipped separately. The applicable delivery charges and any split-shipment information will be displayed at checkout before payment.
Simone may change prices at any time. However, Products will be invoiced at the price displayed when the order is confirmed, except in the case of an obvious pricing error.
8. Payment
Payment is processed securely through Shopify Payments and the payment methods displayed at checkout.
The full price is payable when the order is placed.
Simone does not have access to the customer’s complete bank card details.
Where payment is refused, cancelled or identified as potentially fraudulent, Simone may suspend or cancel the order.
9. Delivery area
At launch, Simone delivers to addresses located within the European Union.
The customer must provide a complete and accurate delivery address. Simone cannot be held responsible for delays or failed delivery caused by incorrect or incomplete information supplied by the customer.
10. Order preparation and shipment
Products are prepared and shipped by the relevant partner brand on Simone’s behalf.
Estimated preparation and delivery times are displayed during checkout. Where several brands are included in the same order, the Products may arrive in separate parcels and on different dates.
The fact that a partner brand prepares the parcel does not change the customer’s contractual relationship with Simone. Simone remains the customer’s sole point of contact regarding the order.
Any delivery date displayed as an estimate is indicative unless expressly described as guaranteed. Simone will nevertheless arrange delivery within the period communicated to the customer and, in the absence of any stated period, no later than thirty days after the conclusion of the contract.
11. Delivery problems
The customer should inspect the parcel and Products promptly after delivery.
If a parcel appears damaged, incomplete or tampered with, or if a Product is missing or damaged, the customer should contact Simone as soon as possible via the online form, providing:
- the order number;
- a description of the issue;
- and, where possible, photographs of the parcel and Product.
This notification does not limit the customer’s statutory rights.
12. Right of withdrawal
Except where a legal exception applies, customers have fourteen days from the date on which they receive the Product to notify Simone of their decision to withdraw from the purchase, without giving any reason.
The customer may exercise the right of withdrawal by:
- emailing contact@simoneshop.com with an unambiguous statement;
- or using the contact form
The customer must clearly identify the order and Products concerned.
The legal withdrawal period is fourteen days from receipt of the goods.
13. Return procedure
Before sending a Product back, the customer must contact Simone at contact@simoneshop.com or via the contact form.
Simone will provide the appropriate return address, which may be the address of the partner brand that shipped the Product.
Products must not be returned to an address other than the one supplied by Simone.
After notifying Simone of the withdrawal, the customer must send the Product back within fourteen days.
Except where the Product is defective, non-conforming or incorrectly supplied, return shipping costs are borne by the customer.
Simone recommends using a tracked shipping service and retaining proof of postage. The customer remains responsible for the parcel until it is delivered to the designated return address.
14. Condition of returned Products
Customers may inspect and try on Products only to the extent reasonably necessary to establish their nature, characteristics and fit, as they would in a physical store.
Returned Products should be:
- unworn other than for reasonable fitting;
- unwashed;
- clean and undamaged;
- free from stains, odours or signs of use;
- returned with their original labels and, where reasonably possible, original packaging.
15. Refunds following withdrawal
Where the right of withdrawal is validly exercised, Simone will refund:
- the price of the returned Product;
- and the standard outbound delivery cost attributable to that Product, where required by law.
Any additional delivery cost resulting from the customer choosing a more expensive delivery method than the least expensive standard option offered will not be refunded.
The refund will be made using the same payment method used for the original purchase, unless the customer expressly agrees otherwise and incurs no additional fees.
Simone may withhold the refund until the returned Product has been received.
The refund will be issued no later than fourteen days after Simone is informed of the customer’s decision to withdraw, subject to the lawful right to withhold it as described above.
16. Exchanges
Simone aims to accommodate exchange requests whenever reasonably possible.
Customers wishing to exchange a Product should contact Simone before returning their order.
Exchanges are subject to product availability, stock levels and operational feasibility. Depending on the circumstances, Simone may offer an exchange for another size, colour or Product, or alternatively process the request as a return and refund in accordance with these Terms.
Additional shipping costs may apply. Any applicable costs will always be communicated to the customer before the exchange is confirmed.
17. Exceptions to the right of withdrawal
The right of withdrawal does not apply where a statutory exception applies, including, where relevant:
- Products made to the customer’s specifications or clearly personalised;
- sealed Products that are unsuitable for return for health-protection or hygiene reasons once unsealed;
- Products that, after delivery, have become inseparably mixed with other items;
- any other situation excluded by applicable consumer law.
Any applicable exception will be clearly indicated on the relevant Product page before purchase.
18. Defective, damaged or non-conforming Products
The commercial return policy and the right of withdrawal are separate from the customer’s statutory rights.
If a Product is defective, damaged, incorrectly supplied or does not conform to the order, the customer must contact Simone via the contact form.
Simone will coordinate the claim with the relevant partner brand, but Simone remains responsible to the customer as the seller.
Where the claim is covered by a statutory guarantee, return and replacement shipping costs will not be charged to the customer.
Depending on the circumstances and applicable law, the customer may be entitled to repair, replacement, a price reduction or cancellation and refund.
19. Statutory legal guarantees
Products sold by Simone benefit from the French statutory guarantee of conformity under Articles L.217-3 et seq. of the French Consumer Code and the statutory guarantee against hidden defects under Articles 1641 et seq. of the French Civil Code.
Under the statutory guarantee of conformity, the consumer has a period of two years from delivery of the Product to seek implementation of the guarantee where a lack of conformity appears.
The consumer may request repair or replacement, subject to the statutory conditions. Where these remedies are impossible, disproportionate, delayed beyond the lawful period or cause major inconvenience, the consumer may be entitled to a price reduction or termination of the sale.
The statutory guarantee against hidden defects may apply where a hidden defect makes the Product unfit for its intended use or significantly reduces that use. The consumer may seek cancellation of the sale or a reduction in price under the conditions prescribed by law.
20. Customer service
Customers should contact Simone for all questions concerning:
- orders;
- delivery;
- returns;
- refunds;
- defective or non-conforming Products.

21. Customer accounts
Creating an account is optional.
Customers are responsible for maintaining the confidentiality of their login information and for providing accurate and up-to-date information.
Simone may suspend or delete an account used fraudulently, unlawfully or in breach of these Terms.
22. Email marketing
Customers may choose to subscribe to Simone’s marketing communications.
Subscription is voluntary and separate from placing an order. Customers may unsubscribe at any time through the link included in each marketing email.
Transactional emails necessary to process an order are not marketing communications and may still be sent.
23. Intellectual property
All Website content, including Simone’s name, visual identity, texts, photographs, videos, graphics, selection structure and editorial content, is protected by intellectual property law.
No Website content may be copied, reproduced, altered, distributed or commercially used without prior written permission.
Third-party trademarks and brand content remain the property of their respective owners.
24. Website availability
Simone aims to keep the Website accurate and accessible but does not guarantee uninterrupted or error-free access.
The Website may temporarily be unavailable due to maintenance, technical problems or events outside Simone’s reasonable control.
Nothing in this clause limits Simone’s mandatory obligations concerning orders already placed.
25. Liability
Simone is responsible for properly performing its obligations under the sales contract, subject to applicable law.
Simone will not be liable where failure or delay results from:
- the customer’s own act or omission;
- an unforeseeable and unavoidable act of a third party;
- or an event of force majeure.
Nothing in these Terms excludes or limits liability or consumer rights where such exclusion or limitation is prohibited by law.
26. Force majeure
Neither party will be liable for failure or delay caused by an event beyond its reasonable control that qualifies as force majeure under French law.
Where such an event affects an order, Simone will inform the customer and seek an appropriate solution. Where fulfilment becomes impossible, the affected order will be refunded.
27. Complaints

28. Governing law and jurisdiction
These Terms are governed by French law.
Nothing in these Terms deprives a consumer residing in another European Union country of any mandatory protection granted by the law of their country of habitual residence.
In the event of a dispute, the parties will first seek an amicable resolution.
Where no amicable solution is reached, the consumer may bring proceedings before any court having jurisdiction under applicable consumer and European Union law.
29. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.
30. Changes to these Terms
Simone may update these Terms from time to time.
The version applicable to an order is the version accepted by the customer when the order is placed.
